Terms of Service

Please read these terms carefully. They define the relationship between you and Mold X Inspectors when you use our website or engage our services.

Effective date: January 1, 2026

1. Acceptance of terms

These Terms of Service ("Terms") are a binding agreement between you ("you," "Client") and Mold X Inspectors ("Mold X," "we," "us," or "our"), an independent environmental diagnostics firm headquartered in Glendale, California. By accessing moldxinspectors.com (the "Site"), requesting a quote, scheduling an inspection, or accepting an inspection report, you agree to be bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, you must not use the Site or our services.

2. Scope of services

Mold X provides independent visual inspection, moisture mapping, thermal imaging, air and surface sampling, laboratory coordination, and written reporting related to mold and indoor environmental conditions. Specifically:

  • We inspect, test, and report. We do not perform mold remediation, demolition, water-damage restoration, or construction work of any kind.
  • Our reports document conditions observed and measurements taken on the date and time of inspection only. They do not predict future conditions, and they do not warrant the absence of mold elsewhere on the property or at any later time.
  • Laboratory analysis is performed by independent AIHA-LAP accredited laboratories. We rely on their results in good faith but do not warrant their accuracy beyond standards generally accepted in the industry.
  • Recommendations in our reports are advisory. Implementation, hiring of remediation contractors, and any subsequent work are the Client's responsibility.

3. Scheduling and access

  • Inspections are scheduled by mutual agreement and confirmed by email or text. The Client is responsible for ensuring legal and physical access to all areas to be inspected.
  • If access cannot be granted at the scheduled time, or if conditions on site (occupants, pets, hazards, active leaks, electrical hazards) prevent safe inspection, we may reschedule.
  • Calls and inspection visits are available 24/7, including routine evenings and weekends. Every visit, including emergency attendance, is scheduled by mutual agreement based on location, safe access, scope, and inspector availability and is not guaranteed to be immediate or same-day. Any applicable service terms are disclosed before work begins.

4. Fees, invoicing, and payment

  • Standard residential pricing is $199 for the initial inspection or $349 with two included laboratory samples; additional samples are $99 each. Large homes, commercial properties, and specialty scopes are quoted in writing.
  • Laboratory fees, when applicable, are passed through at cost or at a disclosed markup and added to the final invoice.
  • Payment is due upon delivery of the report unless other terms have been agreed in writing. Reports may be withheld until payment clears.
  • Past-due balances accrue interest at one and one-half percent (1.5%) per month or the maximum rate permitted by California law, whichever is lower. The Client is responsible for collection costs and reasonable attorney's fees.
  • All fees are non-refundable once the inspection has been performed.

5. Limits of inspection

The Client acknowledges and agrees that:

  • Our inspections are non-destructive. We do not cut, drill, or remove finishes unless specifically agreed and authorized in writing by the property owner.
  • We do not move heavy furniture, stored belongings, or appliances. Areas concealed by such items may not be inspected.
  • We do not inspect areas that are inaccessible, unsafe, or that would require specialized equipment beyond our customary toolkit (for example, scaffold-required heights, confined-space entry, or live electrical work).
  • Mold and moisture conditions can change rapidly. A clear inspection at one moment in time does not guarantee future conditions.
  • We do not perform structural, electrical, plumbing, code-compliance, pest, asbestos, lead, radon, or HVAC engineering inspections unless explicitly contracted to do so.
  • Where conditions warrant referral to a remediation contractor, industrial hygienist, structural engineer, or licensed medical professional, we will say so. We do not refer to specific vendors as a matter of policy.

6. Reports and use

  • Reports are prepared exclusively for the named Client and are not transferable without our written consent. Third parties who rely on a report without our consent do so at their own risk.
  • We grant the Client a non-exclusive, non-transferable license to use the report for the property and purpose specified at the time of engagement (for example, a real estate transaction, insurance claim, or owner's records).
  • Reports may not be altered, excerpted, or paraphrased in a way that misrepresents their content. The full report must be provided when shared.
  • We retain copyright in the form, layout, photographs, and written content of every report.

7. No medical or legal advice

Our reports describe environmental conditions. They do not diagnose health conditions and are not a substitute for professional medical evaluation. They do not constitute legal advice. The Client is responsible for consulting qualified medical, legal, real estate, insurance, and remediation professionals as appropriate.

8. Warranties and disclaimers

Mold X performs services with the degree of care, skill, and diligence customarily applied by qualified environmental inspection firms operating in California. Except as expressly stated in these Terms, the Site and our services are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of laboratory results, and absence of mold or moisture conditions not observed during inspection.

9. Limitation of liability

To the maximum extent permitted by California law, the total cumulative liability of Mold X to the Client and to all persons claiming through the Client, for any and all claims arising out of or related to an inspection, report, or use of the Site — whether based in contract, tort, negligence, strict liability, indemnity, or otherwise — shall not exceed the amount actually paid by the Client to Mold X for the specific inspection giving rise to the claim.

In no event shall Mold X be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost rents, diminution in value, loss of use, business interruption, or cost of remediation, even if Mold X has been advised of the possibility of such damages.

These limitations are an essential element of the bargain between the parties and apply notwithstanding any failure of essential purpose of any limited remedy.

10. Indemnification

The Client agrees to indemnify, defend, and hold harmless Mold X, its owners, employees, contractors, and laboratory partners from and against any claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to (a) the Client's breach of these Terms, (b) the Client's misuse or unauthorized distribution of any report, (c) physical conditions at the property that pose a risk to inspectors and were not disclosed in advance, or (d) any third-party claim that the Client allowed to rely on a report without our written consent.

11. Property condition and assumption of risk

The Client warrants that the property is reasonably safe to inspect, that any known hazards (asbestos, lead, biological waste, structural instability, aggressive animals, firearms, illicit substances) have been disclosed in advance, and that utilities are functional. Mold X reserves the right to suspend, modify, or terminate any inspection that becomes unsafe and to charge for time and materials reasonably incurred up to that point.

12. Confidentiality

We treat client information and inspection findings as confidential and disclose them only to the Client, parties the Client has authorized in writing, our laboratory and service-provider partners, or as required by law. We may use de-identified, aggregated data for internal quality assurance, training, and statistical purposes.

13. Intellectual property

The Site and all content on it — including text, graphics, photographs, logos, the Mold X Inspectors mark, the "Clarity. Precision. Proof." tagline, report templates, methodology documents, and software — are owned by or licensed to Mold X and are protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission, except as expressly permitted by these Terms.

14. Acceptable use of the site

You agree not to:

  • Use the Site in any way that violates applicable law or regulation.
  • Attempt to gain unauthorized access to any portion of the Site, related systems, or networks.
  • Introduce viruses, trojans, worms, or other malicious code.
  • Scrape, harvest, or extract data from the Site by automated means without our written permission.
  • Impersonate any person, misrepresent your affiliation, or submit false information to obtain a quote or service.
  • Reproduce, frame, or republish substantial portions of the Site for commercial purposes.

15. Third-party services

The Site may contain links to or integrations with third-party services. We do not control and are not responsible for the content, policies, or practices of those services. Your use of any third-party service is governed by that party's terms.

16. Force majeure

Mold X shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, fire, flood, earthquake, wildfire, severe weather, civil unrest, government action, public-health emergencies, labor disputes, utility interruptions, or supply-chain failures. We will make reasonable efforts to reschedule affected inspections promptly.

17. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or our services shall be the state and federal courts located in Los Angeles County, California, and each party consents to personal jurisdiction in those courts.

18. Dispute resolution

Before filing any legal action, the parties agree to attempt to resolve disputes in good faith through direct negotiation for a period of thirty (30) days. If negotiation fails, the parties agree to attempt non-binding mediation in Los Angeles County before a mutually selected mediator, with costs shared equally. Nothing in this section prevents either party from seeking injunctive or equitable relief in court to protect intellectual property or confidential information.

19. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent. Failure to enforce any provision shall not be deemed a waiver of that or any other provision.

20. Entire agreement

These Terms, together with our Privacy Policy and any written engagement letter, quote, or work authorization signed by the parties, constitute the entire agreement between the Client and Mold X regarding the subject matter and supersede all prior or contemporaneous communications, whether oral or written.

21. Changes to these terms

We may revise these Terms at any time by posting an updated version on the Site. Material changes will be communicated by updating the "Effective date" above and, where appropriate, by direct notice to active clients. Your continued use of the Site or our services after changes become effective constitutes acceptance of the revised Terms.
